सामान्य नियम:
किसी Municipality द्वारा किए गए contract, agreement, expenditure से संबंधित लागत एवं expenses का भार Municipal Fund पर होता है।
अर्थात् केवल इस आधार पर कि किसी contract को Chairperson, Vice-Chairperson या member ने Municipality की ओर से किया है, वे सामान्यतः personally liable नहीं होंगे।
General Rule:
The costs and expenses related to contracts, agreements, expenditures made by a Municipality shall be charged to the Municipal Fund.
That is, merely because a contract was made by the Chairperson, Vice-Chairperson or member on behalf of the Municipality, they will not generally be personally liable.
Personal Liability कब आएगी?
यदि:
• municipal money/property का misapplication हुआ;
• municipal property का loss/waste हुआ;
• संबंधित व्यक्ति उस misapplication में party था;
• या loss/waste/misapplication उसके misconduct या neglect से हुआ/सुगम हुआ;
तो संबंधित Chairperson, Vice-Chairperson, member तथा statutory circumstances में CMO/अन्य executive authority liable हो सकते हैं।
When does Personal Liability arise?
If:
• there is misapplication of municipal money/property;
• there is loss/waste of municipal property;
• the concerned person was party to such misapplication;
• or the loss/waste/misapplication occurred/facilitated due to their misconduct or neglect;
then the concerned Chairperson, Vice-Chairperson, member and in statutory circumstances CMO/other executive authority may become liable.

Municipality के किसी contract या employment में interest रखता है, तो वह Disciplinary action के लिए liable हो सकता है।

The Municipality has the power to acquire and hold movable property and immovable property for the purposes of the Act.

Section 68 gives a detailed list of public properties that vest in the Municipality.
Such property:
• vests in the Municipality;
• remains under the direction, management and control of the Municipality;
• the Municipality holds/applies it as a trustee for the purposes of the Act.
But: Property specially reserved by the State Government may be outside this general vesting.

Government Land की Resumption:
State Government Official Gazette में notification द्वारा Municipality में vested Government land को resume कर सकती है यदि:
1. Municipality ने land को mismanage किया हो
या
2. State Government को वह land public interest में चाहिए।
ऐसी resumption State Government द्वारा निर्धारित terms पर होगी।
Resumption of Government Land:
The State Government may, by notification in the Official Gazette, resume Government land vested in the Municipality if:
1. The Municipality has mismanaged the land
or
2. The State Government requires the land in public interest.
Such resumption shall be on terms determined by the State Government.

1. Agreement द्वारा immovable property, easement affecting immovable property acquire कर सकती है।
2. Exchange द्वारा property acquire कर सकती है।

With prior approval of the State Government, on prescribed terms and conditions, the Municipality may:
1. Acquire immovable property or easement affecting immovable property by Agreement.
2. Acquire property by Exchange.
3. Take immovable property on Lease/Hire.
Municipality को Gift/Grant:
Municipality donor से grant, dedication, income, movable property, immovable property receive कर सकती है, यदि उससे Municipality अपने functions discharge करने में benefit प्राप्त करती है।
Gift/Grant to Municipality:
Municipality may receive grant, dedication, income, movable property, immovable property from donor, if it benefits the Municipality in discharging its functions.
Municipality as Beneficiary of Trust:
Municipality किसी trust की beneficiary भी हो सकती है।
Section 69 में विशेष रूप से Charitable and Religious Trusts Act, 1920 और Indian Trusts Act, 1882 के तहत बनाए गए trusts का उल्लेख है।

यदि कोई व्यक्ति municipal area में non-agricultural land hold करता है और वह land Municipality द्वारा जारी lease या licence के अधीन नहीं है, तो prescribed manner में अपने rights Municipality के पक्ष में surrender कर सकता है।
उद्देश्य: Municipality से leasehold rights प्राप्त करना।
Municipality ऐसे rights accept कर सकती है।
If a person holds non-agricultural land in the municipal area and such land is not under a lease or licence issued by the Municipality, they may surrender their rights in favour of the Municipality in the prescribed manner.
Purpose: To obtain leasehold rights from the Municipality.
The Municipality may accept such rights.
Surrender का परिणाम:
Municipality द्वारा rights accept करने के बाद उस land में holder के सभी rights Municipality में vest हो जाते हैं।
इसके बाद: prescribed conditions, applicable Act/Rules, State Government द्वारा निर्धारित fee/charges के अधीन Municipality holder को lease issue कर सकती है।
Result of Surrender:
After the Municipality accepts the rights, all rights of the holder in that land vest in the Municipality.
Thereafter, subject to prescribed conditions, applicable Act/Rules, fee/charges determined by the State Government, the Municipality may issue a lease to the holder.

When any land or right in land is required for the purposes of the Act, the State Government may acquire it on the request and behalf of the Municipality.
This acquisition shall be according to the applicable land-acquisition law at that time.
Land outside Municipal Area: Compulsory acquisition can be inside or outside municipal limits, if the land/right is required for the purposes of the Act.

Transfer की पहली शर्त:
कोई lease, sale, regularization, allotment, transfer, contract तभी Municipality पर binding होगा जब वह Act + Rules के अनुरूप हो।
First Condition of Transfer:
Any lease, sale, regularization, allotment, transfer, contract shall bind the Municipality only if it is in accordance with the Act + Rules.
Government Land Transfer:
Government land से संबंधित lease, sale, regularization, allotment, transfer, contract तब तक valid नहीं होगा जब तक Prescribed Authority द्वारा prescribed manner और conditions में confirm न किया जाए।
Government Land Transfer:
Any lease, sale, regularization, allotment, transfer, contract relating to Government land shall not be valid until confirmed by the Prescribed Authority in the prescribed manner and conditions.

EWS और LIG Reservation:
यदि Municipality prescribed Group Housing / Township Project के लिए municipal land lease/sale/allot/transfer करती है, तो कम-से-कम 20% plots या housing units EWS और LIG persons को concessional rates पर उपलब्ध कराने की condition लागू होती है, cross-subsidization के माध्यम से, जैसा State Government notify करे।

If the Municipality leases/sells/allots/transfers municipal land for a prescribed Group Housing / Township Project, then a condition applies that at least 20% plots or housing units shall be made available to EWS and LIG persons at concessional rates, through cross-subsidization, as notified by the State Government.

(a) Section 68(1)(h) के तहत Municipality में vested Government land;
(b) Rajasthan Land Revenue Act, 1956 की Section 3 में defined Nazul Land;
(c) State Government द्वारा Municipality के disposal पर रखी गई land।

Record मांग सकता है: State Government या authorized officer Record मांग सकता है यदि वह Municipality/Chairperson/officer के किसी proposal की correctness, legality, propriety जाँचना चाहता है।
Proposal को Abeyance में रखने की Power: Record examination के दौरान State Government/authorized officer निर्देश दे सकता है कि proposed lease, sale, regularization, allotment, transfer को Abeyance में रखा जाए।
Hearing का अवसर: यदि examination के बाद State Government/authorized officer को लगे कि proposal Act के विरुद्ध है, तो interested persons को reasonable opportunity of being heard देने के बाद action लिया जाता है।
May Call for Records: The State Government or authorized officer may call for records to examine the correctness, legality, propriety of any proposal of the Municipality/Chairperson/officer.
Power to keep Proposal in Abeyance: During record examination, the State Government/authorized officer may direct that the proposed lease, sale, regularization, allotment, transfer be kept in Abeyance.
Opportunity of Hearing: If after examination the State Government/authorized officer finds the proposal contrary to the Act, action is taken after giving reasonable opportunity of being heard to interested persons.

Unauthorized Occupation:
यदि Municipality/Chairperson/officer द्वारा Act के विरुद्ध किए गए lease, sale, allotment, transfer, contract के आधार पर कोई व्यक्ति municipal/Government land पर possession लेता है, तो उसे Unauthorized Occupant माना जा सकता है।
उस पर Rajasthan Public Premises (Eviction of Unauthorized Occupants) Act, 1964 के अनुसार eviction एवं rent/damages की liability लागू हो सकती है।
Invalid Transfer का Consideration: यदि ऐसा transfer/contract confirm नहीं होता और व्यक्ति को land से evict किया जाता है, तो Municipality/Chairperson/officer द्वारा प्राप्त consideration को संबंधित व्यक्ति को refund करना होगा।
Unauthorized Occupation:
If a person takes possession of municipal/Government land on the basis of a lease, sale, allotment, transfer, contract made by the Municipality/Chairperson/officer contrary to the Act, they may be considered an Unauthorized Occupant.
They may be subject to eviction and liability for rent/damages under the Rajasthan Public Premises (Eviction of Unauthorized Occupants) Act, 1964.
Consideration of Invalid Transfer: If such transfer/contract is not confirmed and the person is evicted from the land, the consideration received by the Municipality/Chairperson/officer shall be refunded to the concerned person.
